September 2000 - Did They Really Say That?


From Les Pickett of Houston (Galloway, Johnson, etc.), these two exchanges from a recent deposition he took of the plaintiff in a personal injury case.

Q. And it's your testimony that you did not have memory problems before the accident?

A. No sir. I don't think so. I don't recall having memory problems.

(laughter)

Okay. And I think for some of your testimony, I gather that you drink alcohol?

A. Usually only on occasions, but I kind of stay away from it unless I'm at where my wife works.

Q. Okay. I know it's hard to quantify. It would be hard for me to quantify how much beer I drink, but how much would you say you drink when you do drink?

A. When I do drink? Too much.

(laughter)

A. Oh, my goodness.
